
Last week the Michigan Supreme Court released an important Opinion declaring that Governor Whitmer exceeded her authority by issuing Executive Orders related to the COVID-19 pandemic which were effective after April 30, 2020. The result is confusion amongst businesses and employers as to which COVID-related mandates remain in place. In addition, the Michigan Department of Health and Human Services released an Emergency Order which includes many, but not all, of the Governor’s earlier requirements for face coverings, gathering limits and restaurants.
